DUI / Drunk Driving Charges

If you or a loved one has been charged with a DUI (driving under the influence) or related offense, it is essential that you obtain the services of an experienced drunk driving defense attorney. Drunk driving is a serious crime which can result in suspension or revocation of your driver's license, thousands of dollars in fines, and possible jail time. The long-term repercussions can include loss of employment, an increase in your insurance premiums or cancellation of auto insurance altogether, plus a loss of reputation.

Many people believe there is no hope of avoiding conviction once charged with a DUI, but this is a misconception. There ARE alternatives to pleading guilty. DUI cases can be successfully defended or negotiated by an experienced attorney who knows that, like any other legal case, there are a variety of factors at play in your DUI arrest. At VanDerGinst Law, we have experienced attorneys who are former prosecutors themselves. They know the law well from both sides of the equation and have successfully obtained acquittals, dismissals and reductions for DUI charges and have had suspensions and/or revocations set aside.

Such an attorney is equipped to do this by having full knowledge of the laws that pertain to DUI charges and by fully exploring the "facts" on which your charge is based. For example, different body types, genetics, and exposure to alcohol result in different tolerances, meaning that people's bodies process and react to alcohol differently. But this means that a chemical measure of your alcohol level, such as with the common breathalyzer, is also prone to variation. Breathalyzers have varying degrees of accuracy, and while most states recognize breathalyzer results as probable cause for initial charges, many do not recognize their readings as valid proof of the actual blood-alcohol level in court.

This is just one example of drunk driving "proof" that is subject to interpretation, variation, and error. Field sobriety tests, based solely on the opinions of the officers, are often no better, and the list goes on. Our DUI attorneys have the knowledge and background necessary to thoroughly dissect speculation from fact, meaning that "appearing" to be intoxicated may no longer be enough to convict you of that charge. Keep in mind, it is perfectly legal for an adult (21 and over) to drive a vehicle after consuming alcohol; it is only illegal if you have consumed enough alcohol to put your blood alcohol content over the legal limit or to otherwise impair your ability to drive safely. A drunk driving conviction is no small matter. In nearly every case, it goes on your permanent criminal record, and in many cases it will even be listed as a felony.

DUI cases can be successfully defended or negotiated by an experienced attorney. If your drunk driving charge was based on inaccurate or speculative evidence, if you have not been charged with any prior violations, or even if you have, you DO have more options than to simply plead guilty.

Ultimately, the success of each case depends upon the individual facts and circumstances, and we will fight hard to ensure that your rights are protected and that you are represented in a professionally responsible manner. Should you find yourself in any of these situations, our experienced drunk driving defense attorneys are your most powerful allies. We can fight hard on your behalf to keep a drunk driving conviction from negatively affecting the future of you and your loved ones.
